1. Introduction {#intro}

Welcome to kokoclick! These Terms and Conditions (“T&Cs”) govern your use of our website kokoclick.co.uk (the “Site”), including browsing, posting advertisements, and contacting other users.

The Site is operated by kokoclick (a trading name), a husband-and-wife partnership based in Bulgaria. We hold a registered UK trademark for “kokoclick” (UK00004247327). Our principal place of business is 7 Stara Planina, Gradishte Village, 5435 Sevlievo, Bulgaria. We are not VAT-registered.

By accessing or using the Site, you agree to be bound by these T&Cs. If you do not agree, you must not use the Site.

2. Acceptance of Terms {#acceptance}

By using the Site, you confirm that you:

Are at least 18 years old, or aged 16–17 with verifiable parental/guardian consent (see our Privacy Policy for verification process).
Are legally capable of entering into binding contracts.
If acting for a business, have authority to bind that business and will identify it clearly when posting ads.

We reserve the right to refuse service to anyone for any reason consistent with applicable law.

3. Services Offered {#services}

kokoclick is an online classifieds platform allowing users to post advertisements in various categories. We act solely as a neutral intermediary and do not:

Facilitate payments or deliveries.
Act as agent, broker, or guarantor for any transaction.
Verify, endorse, or take responsibility for the accuracy, quality, safety, or legality of listed items/services.

Transactions are strictly between users. If you are a UK consumer, your statutory rights under the Consumer Rights Act 2015 (e.g., goods must be as described) are preserved when dealing with other users, but we are not a party to those contracts.

4. User Accounts {#accounts}

To post ads, you must create an account with accurate, complete, and up-to-date information. You are responsible for:

Maintaining the confidentiality of your login credentials.
All activity under your account.
Immediately notifying us at customerservice@kokoclick.co.uk of any suspected unauthorized use.

You must not share your account. We may require identity verification (e.g., photo ID) to prevent fraud. We reserve the right to suspend or terminate accounts for any breach of these T&Cs or suspected illegal activity.

5. Posting Advertisements {#posting}

Ads must be posted in the correct category with truthful, complete descriptions. You are solely responsible for compliance with all applicable laws, including UK and Bulgarian regulations. Specific requirements:

Pet ads: Comply with the Animal Welfare Act 2006 and our Pets Policy.
Prohibited items/services (non-exhaustive):
- Illegal drugs or paraphernalia (Misuse of Drugs Act 1971).
- Weapons, firearms, ammunition (Offensive Weapons Act 2019).
- Counterfeit, stolen, or fraudulent goods.
- Adult services or explicit content.
- Hate speech, violence, or discrimination.
- Endangered species/products (CITES / Wildlife and Countryside Act 1981).
- Hazardous materials (e.g., flammable, toxic).

Multiple ads for the same item, spam, or “bumping” are prohibited. We may remove non-compliant ads without notice.

6. Fees and Payments {#fees}

We may charge fees for premium listings or services, clearly stated on the Site. You agree to pay all applicable fees. Fees are non-refundable except as required by law.

Under the Consumer Contracts Regulations 2013, you may cancel a paid service within 14 days of purchase and receive a refund, unless the service has been fully performed with your consent.

Fee changes will be notified at least 14 days in advance via email or Site notice. Refund requests: support@kokoclick.co.uk.

7. Prohibited Conduct {#prohibited}

You agree not to:

Post unlawful, fraudulent, defamatory, obscene, or harassing content.
Impersonate any person or misrepresent affiliations.
Disrupt Site operations (e.g., DDoS, malware).
Attempt unauthorized access to accounts or systems.
Collect personal data without consent (UK GDPR).

Violations may result in immediate suspension or termination.

8. Liability {#liability}

kokoclick provides the Site “as is”. We do not guarantee availability, accuracy, or transaction success.

To the fullest extent permitted by law:

We are not liable for losses arising from user transactions, content, or Site use.
Our total liability is limited to £100 or the fees you paid us in the last 12 months (whichever is greater).
We exclude liability for indirect losses (e.g., lost profits, data).

Nothing excludes liability for: death/personal injury from negligence, fraud, or other liabilities that cannot be limited by law (Unfair Contract Terms Act 1977).

9. Intellectual Property {#ip}

All Site content (logos, text, design) is owned by kokoclick or its licensors. You may not copy, modify, or distribute it without permission.

By posting content, you:

Warrant you own or have rights to it.
Grant kokoclick a non-exclusive, royalty-free, worldwide license to use, display, and store it for platform operations.
Indemnify us against third-party IP claims.

10. Termination {#termination}

We may suspend or terminate your account at any time for breach of T&Cs, illegal activity, or operational reasons.

Upon termination:

You lose access to your account and ads.
You may appeal in writing to customerservice@kokoclick.co.uk within 14 days with reasons and account details. We will respond within 14 days.

11. Changes to Terms {#changes}

We may update these T&Cs. Material changes (e.g., new fees, rules) will be notified via email and Site banner for 30 days. Continued use after changes means acceptance. To disagree, stop using the Site and delete your account.

Our Privacy Policy forms part of these T&Cs and explains how we collect, use, and protect your data under UK GDPR and the Data Protection Act 2018.

These T&Cs are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, but UK consumers may bring claims in their local courts.

We are not liable for failures due to events beyond our control (e.g., war, natural disasters, internet outages, government actions).

16. Third-Party Links {#thirdparty}

The Site may contain links to third-party sites. We are not responsible for their content, privacy, or practices. Use them at your own risk.
